TL;DR: Start with Referral Partners, Not Sales Reps
Referral partners = lower risk, lower cost, you keep control. Graduate to commission reps only when you have more leads than you can handle.
Phase 1: Referral Partner Network (Now → Month 3)
Commission Structure
- 10% of first-year revenue on closed deals, paid on receipt of first client payment
- Example: Client signs 6-month engagement at 30K → $3,000 commission
- Alternative: Flat $1,500 per qualified introduction that closes

Deal Registration (Simple)

- You review within 48 hours (accept / need more info / decline)

- On close + first payment → commission paid via Xero
Phase 2: Optimize (Months 4-6)
- Track which partners produce, focus on top 3
- Refine ICP based on what’s closing
- Consider graduated tiers: 10% base → 12.5% after 3 referrals → 15% after 5

- One rep, 90-day trial, commission-only at 15-20%
- Minimum 3 qualified opportunities per month
- Weekly check-ins (not daily — IRS classification risk)
- Mandatory Fireflies on all calls (non-negotiable)
Recording Requirements
- Colorado = one-party consent (you can record without telling)
- But always disclose anyway for trust + multi-state compliance
- Fireflies built-in compliance: Settings > Meeting Compliance > enable participant notification
- 11 states require all-party consent: CA, DE, FL, IL, MD, MA, MT, NV, NH, PA, WA
- Agreement clause: “Contractor agrees all meetings shall be recorded using Company’s designated platform”

- Overpromising to prospects
- Misrepresenting services
- Refusing transparency on conversations
- Only chasing large deals, ignoring bread-and-butter
- Demanding exclusivity before proving results
- Pressure to lower prices
Legal Framework
Referral Partner Agreement — Essential Clauses

- Non-competes are void below $130,014/year (2026 threshold)
- Non-solicitation requires earnings above ~$78,008/year
- Written notice required before any restrictive covenants
- Penalties: $5,000/worker + damages + attorney fees for violations
- Use NDAs instead — enforceable in Colorado if reasonable
